Even though this story is not technically about bikers I thought it was important enough to include here. If you have not been keep up with things a few months ago a Supreme Court ruling extended the eminent domain power of local governments. This ruling effects not only bikers, but anyone that owns property. Though many states have laws on the books to limit this power some do not and because of this ruling it opens the door for even more violations of individual property rights.

EPA officials recently informed the Motorcycle Riders Foundation of a new interpretation of the "Control of Emissions >From Highway Motorcycles" document.
The latest document contains the new 2006 Emissions Regulations for Highway Motorcycles and the new interpretation includes the effective date of two essential provisions in the document.

Bikers' Rights: Congressional Hearing on the Motor Vehicle Owners Right to Repair Act (HR2048)

The Energy and Commerce subcommittee on Commerce, Trade, and Consumer Protection met on November 10th to question the motor vehicle manufacturers and aftermarket part industries on the “Right to Repair” bill. Under current law, motor vehicle and motorcycle manufacturers must make available publicly, only information pertaining to the emissions on board diagnostic systems under an Environmental Protection Agency mandate. This results, in some cases forced owners to return to the dealership for other repairs that might have been less expensive and more convenient to fix at a local mechanic or even by getting their own hands dirty.

The Motorcycle Riders Foundation has formally committed to Support HR 2048 The Right to Repair Act of 2005.
The Motor Vehicle Right to Repair Act of 2005 (HR 2048) was introduced this past May by Congressman Joe Barton (R-TX) and Edolphus Towns (D-NY), five months later the bill has over fifty bipartisan supporters. The legislative intent of this measure is to offer protections for the American motor vehicle owner by making it illegal for the manufacturer of the motor vehicle to withhold information necessary to diagnose service or repair the motor vehicle.

The Southern Cross Conference is less than three weeks away. Southern SMRO
Leaders such as Sputnik of TMRA2 are coming here to share their knowledge;
Sputnik changed the Texas helmet with the help of his legislative warriors

How motorcyclists won the right to feel the wind in their hair-and why drivers still have to buckle up. On a Monday afternoon in June 1999, Richard Quigley was riding his Harley
near Capitola, California, when a local police officer pulled him over for
violating the state's helmet law. There ensued a half-hour debate with the
officer and his supervisor about whether Quigley's headgear-a trucker's cap
emblazoned with "United States Freedom Fighter" into which he had inserted a
rigid plastic disc-qualified as a "safety helmet." Quigley, a 61-year-old
with a ponytail and a ZZ Top-style beard who directs Bikers of Lesser
Tolerance of California and once ran for Congress on the Libertarian ticket,
later called the encounter "interesting, informative and fun!"

As you know, Tom McGrath has been representing injured motorcyclists for over 30 years. However, many riders are unaware of the other ways in which The Law Offices of Tom McGrath assists motorcyclists at no cost to them. One is through the Virginia Coalition of Motorcyclists (VCOM) which lobbies on behalf of motorcyclists and fights in the Virginia General Assembly to protect our rights as riders.
Additionally, and of immediate importance, The Law Offices of Tom McGrath will represent any motorcyclist charged with wearing an unapproved helmet free of charge anywhere in the Commonwealth of Virginia.
