Virginia Freedom Riders Bikers' Rights: VA Bikers CALL TO ACTION - Bill 3077 - Your phone calls needed now!

Delegate Abbitt, Patron of HB3077 (Reduces helmet violations to $25), has asked that each of us call the consituent phone number and leave a message asking support of HB3077.

If your Senator is on the Senate Transportation Committee, it is crucial you call and also recruit as many people as you can to call from your district.

If your Senator is not on the Senate Transportation Committee, call and ask that he/she speak with the Senate Transportation Committee members and ask them to support HB3077.

This process is very simple. The toll free number for the constituent line is 800-889-0229. You won't have to make an elaborate speech - you are just leaving a message for your Senator. Simply identify yourself as a constituent and supply your Senator's name. If your Senator is on the Transportation Committee, simply state that you support HB3077 and ask that the Senator vote "yes" to this bill in committee. If your Senator is not a member of the committee, simply state that you support HB3077 and request that your Senator speak with committee members and ask them to vote "yes" to this bill in committee.

Virginia Freedom Riders Bikers' Rights: HB 3077 is out of the House - and on to the Senate!

HB 3077 (Makes the penalty for not wearing an approved helmet or any helmet the same $25 civil fine as the current seatbelt code) made it out of the house today with 51 yeas to 48 nays! Thanks to EACH of you that wrote your Delegate about this bill.

We now need to get started working on the Senate. HB 3700 will most likely end up in the Senate Transportation Committee. NOW is the time to write each of these committee members! Below are the Senators and email addresses:

Virginia Freedom Riders Bikers' Rights: Call to action for all states! VA BYWAYS HELMET BILL - HB2585

Virginia is requesting your out of state help with HB 2585 (Allows riders the choice of whether or not to wear a helmet on roads designated Virginia Scenic Byways). Please write our Delegates and let them know that you would spend your tourism in Virginia if allowed to choose whether or not to wear a helmet on Virginia's beautiful scenic Byways. Virginia Freedom Riders Bikers' Rights: HB 3077 and HB 2585 BOTH to be heard tomorrow (1/26)

Remember I mentioned earlier that this is a short legislative session and things are happening very quickly? Well, HB 3077 (the penalty for not wearing an approved helmet or any helmet the same $25 civil fine as the current seatbelt code) is a definite example. Just yesterday we learned it had been moved from the Transportation Committee to the House Militia, Police and Public Safety Committee with no indication of when it would be heard. I talked to Jim Cannon at 6:05 this morning and he had just learned it was to be heard in the subcommittee THIS morning! HB 2585 (Motorcycle helmets; exempted from wearing thereof on certain byways and highways) was also heard. BOTH came out of the subcommittee with a 3-0 vote. So BOTH are on to be heard by the full committee TOMORROW (1/26).

Both of these bills (HB 3077 and HB 2585) need your support. If you can possibly make the House Militia, Police and Public Safety Committee meeting tomorrow morning (1/26) please plan to attend. It will be held at 9:00AM in House Room C.

I talked to Jim Cannon in Richmond and he has learned that HB 2585 (Motorcycle helmets; exempted from wearing thereof on certain byways and highways) will be heard in the House Militia, Police and Public Safety Committee THIS FRIDAY - January 26 at 9:00 a.m in House Room C. Please write each of the committee members and ask for support, and please plan to make the committee meeting on Friday if you possibly can.

Virginia Freedom Riders Bikers' Rights: Call to action! SB909 - Time to Write!

SB909 will be heard in the Senate Courts of Justice Committee in the near future. Now is the time to write the committee members and ask them to support SB909!

To refresh your memory:

SB909 - Reckless driving; violation of right-of-way resulting in death of another. Provides that a person is guilty of reckless driving if he violates the right-of-way of any motor vehicle causing the death of another. The court must sentence the driver to 90 days in jail and suspend his driver's license for not less than six months or more than three years, although the court may suspend the penalties if the person completes 24 or more hours of community service.

With HB1808 out of Committee, now is the time to start writing our delegates and asking that they support this bill when it comes up for a vote. Below is some information about the bill, and some talking points you may want to use in your correspondence:

HB1808 (Patron - Delegate Poisson) - Allows motorcyclists to ride two abreast in a single traffic lane. http://leg1.state.va.us/cgi-bin/legp504.exe?071+ful+HB1808
Talking Points:
  • Virginia is only one of two states that specifically don’t allow two motorcycles to ride two abreast in a traffic lane.
  • Two motorcycles abreast in a traffic lane aids in making the motorcycles more visible to other traffic.
  • In larger groups of motorcycles, riding two abreast keeps the overall length of the group shorter, and discourages other vehicles from dangerously cutting into the group – an issue motorcyclists riding in groups often face.

Virginia Freedom Riders Bikers' Rights: Helmet Law, Etc.: For Safety's Sake, Why Not Just Ban Motorcycles Altogether?

Of all tyrannies, a tyranny exercised for the good of its victims may be the most oppressive. It may be better to live under robber barons than under omnipotent moral busy-bodies. The robber baron's cruelty may sometimes sleep, his cupidity may at some point be satiated; but those that torment us for our own good will torment us without end, for they do so with the approval of their own conscience. --C.S. As this newspaper pointed out in an editorial last week, the defeat of Delegate Bill Janis' attempt to repeal the state's motorcycle-helmet law does not mean, as the more hyperventilating riders of Hondas and Harleys would have it, that Virginians are walk- ing around in chains. A little perspective is in order. The Old Dominion is not Red China or Saudi Arabia; there's no need to stamp "REPEALED" on the Bill of Rights quite yet.

But something else is in order as well, namely a clear understanding of just what the defeat of Janis' proposal implies. Philosophically, the mandatory-helmet law is disheartening.

Virginia Freedom Riders Bikers' Rights: HB26 and HB117

We have two bills that need your immediate attention. HB26 (allows auxiliary lighting on motorcycles) eeked out of the Transportation Committee with an 8-7 vote. The next stop is the House floor for a vote. We need you to write EACH of our delegates and ask that they support HB26. Tell them that the number one reason motorists give when causing an accident with a motorcycle is "I didn't see it". Auxiliary lighting makes us more visible and this is a safety issue. Type your letter and hit send.

As expected, HB1400 - bill to repeal mandatory helmet usage by adults 21 and over - was voted on in the House today. The bill failed to pass by 42 - 57.

Thanks to all who worked to get this bill through this year and especially those that dedicated some of their time to go to Richmond and lobby in the capitol. These efforts are priceless and as you can imagine, we need more of this during the off session.

As you know, we have two versions of Blacksmith’s Law this session. House Bill 1117 (Optional additional penalty for certain motor vehicle violations) is patroned by Delegate Athey and Senate Bill 332 (Traffic offenses; additional penalties) is patroned by Senator Obenshain. These bills are facing opposition and we need YOUR help. The Department of Education is opposing that they will administer the program except for motorcycle offenses.
